Assault cases among many heard by Brooke grand jury
WELLSBURG — Several assault cases were among 27 indictments returned by a Brooke County Grand Jury on Monday.
Kenneth M. Spivey, 57, 315 Lee Road, Follansbee, was indicted for strangulation, domestic battery and domestic assault.
The charges stem from an April 5 incident in which Spivey allegedly wrapped a belt around the neck of a woman known to him and used it to drag her around the room, making it difficult for her to breathe and bruising her neck, and threatened to kill her.
Richard Jennings, 33, 220 Fowler Hill Road, Wellsburg, was indicted for burglary, domestic battery, domestic assault, unlawful restraint, interfering with emergency communication, violation of a protective order, and taking the identity of another.
According to the indictment, Jennings punched a woman known to him in the arms and legs and struck her head against a wall, prevented her from leaving and using her phone to call for help, and used her phone to pretend to be her in an effort to obtain money in exchange for photos of her.
Cody Dennis, 36, 1068 Virginia Ave., Follansbee, was indicted for burglary, battery, assault, brandishing a deadly weapon and removal of property.
Dennis allegedly entered a Follansbee home where he threatened a man with a knife, wrestled him to the ground, struck him in the head multiple times and took tools from the property.
Dequan R. Samuel, 21, Apartment 246, 31 Campus East Drive, Bethany, was indicted for malicious assault for allegedly striking a man known to him in the head from behind.
Michael Stewart, 33, Janesville, Wisc., was indicted for malicious assault and grand larceny for allegedly cutting a man’s shoulder with a pocketknife and stealing a vehicle from a Windsor Heights business.
Jeremy Hoit, whose address is unknown, was indicted for gross child neglect creating substantial risk of death or bodily injury and two counts of child abuse resulting in injury.
According to the indictment, Hoit threw a child in his care into the wall, causing her to strike her head; struck her in the face, splitting her lip; and failed to provide a safe environment for her to live in.
Also indicted were:
• Eric Ross, 33, of 630 Allegheny St., Follansbee, for two counts of child abuse resulting in injury for allegedly striking a child in his care in the left buttock and back, bruising both.
• Elizabeth Deavers, 31, and Jordan Deavers, 31, both of 13 Liz Place, Follansbee, each on a count of gross child neglect creating substantial risk of death or bodily injury.
According to the indictment, a child in the Deavers’ care was found to be in a residence “in deplorable conditions and without necessary food, creating a substantial risk of death or serious bodily injury.”
• Doris Arnold, Apartment 3, 1750 Blosser Lane, Follansbee; Jessica Connolly, 41, 334 Orr St., Weirton; and Danika Gegas, 36, 307 Miller Ave., Weirton, all for embezzlement and conspiring to commit a felony.
According to court documents, the three used the rewards system at the restaurant where they worked to pocket more than $1,000 each for themselves.
• David Bocek, 40, Apartment 2, Rear 2810 Weir Ave., Weirton, for driving while his license was revoked for driving under the influence and loud exhaust.
• Douglas M. Freeman, 51, 214 Hideaway Acres Road, New Cumberland, obtaining money under false pretenses and fraudulent schemes for allegedly accepting thousands of dollars for work on several auto projects that he did not do.
• Ashley J. Guiler, 41, 116 Beverly Ave., Weirton, second-offense possession with intent to deliver a controlled substance and conspiring to commit the crime.
• Charles Hendershot, 40, 116 Beverly Ave., Weirton, for entering without breaking, shoplifting, possession of a controlled substance with intent to deliver, conspiring and prohibited person in possession of a firearm.
• Dustin A. Hill, 22, 1672 McCord Hill Road, Wellsburg, fleeing with reckless indifference to others’ safety for allegedly fleeing from a Brooke County sheriff’s deputy and a Follansbee police officer at a high rate of speed and while nearly striking other vehicles between Harmon Creek Road and Edna Street, Weirton, on May 2.
• Timothy P. Iverson, 43, Beech Bottom, failure to register as a sex offender.
• Robert L. Lancaster, 53, 55 Walnut St., Wellsburg, driving while his license was revoked for DUI.
• Dunyasha J. Lawrence, 37, Apartment 2, 100 Spruce St., Follansbee, failure to register as a sex offender.
• James T. Miller, 56, 2092 Northview Road, Wellsburg, failure to register as a sex offender.
• Christian Parr, 39, 243 Pebble Lane, Colliers, destruction of property for allegedly striking a parked car and an air conditioning unit with his vehicle.
• Carol Posey, 64, 1870 Eldersville Road, Follansbee, financial exploitation of an elderly person and six counts of fraud using an access device for allegedly transferring more than $2,000 from the account of a woman with age-related disabilities to another account for her use and for allegedly using the woman’s debit card to obtain more than $700 belonging to her.
• James D. Shields, 28, 200 Columbus Way, Weirton, obtaining money under false pretense for allegedly accepting money to build a retaining wall that he did not build.
• Jessica L. Sorenson, 36, Iowa Falls, Iowa, attempting to conceal or remove a child not in her custody.
• Marquon C. Underwood, 27, 1915 Yankee St., Wellsburg, possession of a controlled substance with intent to deliver and delivery of it.
• Nancy L. Wieduwilt, 55, Lot 34A, 401 Labelle St., Brilliant, failure to register as a sex offender.
