Jefferson County grand jury hands down indictments
STEUBENVILLE — A Steubenville man was indicted Wednesday on charges he videotaped himself raping a toddler and then distributing the images.
The indictment against Cody Tyler Whitacre of 1432 Oak Grove Ave., was one of 12 returned Wednesday by the April term of the Jefferson County grand jury. Also among those indicted were two couples charged with child endangerment, and three men ordered to stand trial for allegedly stomping a man outside the American Legion in downtown Steubenville.
Whitacre was indicted on three counts of rape with an additional finding and five counts of pandering. According to the indictment, Whitacre, 36, performed oral sex on a 3-year-old child on March 7 and again on March 22, then sent the images to other people on March 17, March 21 and March 22.
He was arrested by City Police Saturday and his case was presented directly to the grand jury.
The grand jury also returned true bills charging Michael Kenneth Kirk of 4920 State Route 43, Richmond, and Ashlee Nicole Rea of 3622 County Road 25, Rayland, with child endangerment.
Kirk, 35, was indicted on two felony counts of endangering children, one of them carrying an additional finding that his actions caused serious physical harm to the child, and two felony counts of possession of drugs. Rea, the child’s mother, was indicted on a single felony count of endangering children.
The indictment alleges Kirk of 4920 State Route 43, Richmond, scalded a 3-year-old child on March 2, causing the toddler to suffer burns “all along his buttocks, second- and third-degree burns,” then failed to seek medical treatment for the child, authorities said.
The indictment also alleges Kirk also had methamphetamine and fentanyl in his possession March 16.
Rea, 24, allegedly failed to seek medical treatment for the child.
Authorities maintain both parents were aware of the seriousness of the child’s condition but waited more than a week to obtain medical care for the toddler, who was transferred to a burn unit in Pittsburgh.
Also indicted on child endangerment charges were Raquan Eugene Dawson and Nicole Sha-Qae Hines, both of 707 Wilkins St., Steubenville.
Dawson, 23, was charged by the grand jury with felonious assault, endangering children with an additional finding that his actions caused physical harm, and endangering children. Hines, the child’s mother, was charged with child endangerment.
Dawson allegedly beat the 4-year-old with a belt on Jan. 26 “to the point where he left scars and substantial injuries to the child’s back … because he was bad,” authorities said. The indictment alleges the beating resulted in serious physical harm to the child and that Dawson and Hines failed to ensure the 4-year-old received treatment for his injuries.
The grand jury returned separate true bills charging Darl Keith West, 45, of 815 N. Sixth St., Apt. 404, Steubenville; Raymond E. Jeter Jr., 28, of 1419 Orchard Ave., Steubenville, and Brandon T. Garrison, 32, of 227 Harvard Boulevard, each with one count of felonious assault.
The indictment alleges the three men assaulted a man outside the American Legion in the North End of town March 24, causing him serious physical harm. The victim’s head had to be stapled together in back, he suffered injuries to the area around his eyes and lacerations to his head from being punched and kicked in the head, authorities said. The fight was recorded on video, they said.
Also indicted were:
— Kairaba N. Dixon, 42, 237 N. Ninth St., Steubenville, felonious assault. Dixon allegedly attacked a woman outside Maryland Market Nov. 14, causing substantial injuries to her face and head.
— Miranda Faye Higgins, 38, 340 E. Eighth St., Apt. 2, East Liverpool, theft. While free on bond from a methamphetamine case, Higgins allegedly was caught stealing catalytic converters from vehicles on the TEAM lot Jan. 2. Higgins, who was indicted in October for allegedly possessing 175 grams of methamphetamine and tampering with evidence, was wearing an ankle monitor, authorities said.
— Jasmine A. Portis, 28, 809 Highland Ave., Steubenville, burglary. Portis allegedly broke into the home of a man with whom she had been involved Oct. 5, “likely to steal custody papers that he was going to use against her in court,” authorities said.
— William E. Hoover, 323 Market St., Brilliant, burglary, theft of a motor vehicle and theft. The indictment alleges Hoover, 49, entered a home in the 300 block of Market Street, Brilliant, on Feb. 26, “with purpose to commit therein a criminal offense,” then stole a 1993 Cadillac Eldorado, along with a Samsung TV, cable box, DVD player and coins.
