Pushing it: A city resident was cited and his radio seized Tuesday after he allegedly told police he was going to turn the volume down but didn't. An officer passing through the area minutes later reported hearing the music playing "at an unreasonable volume" and approached him a second time but said this time he told them the noise ordinance isn't in force until 7 p.m. so he wasn't lowering the volume, even though they read him the actual ordinance which states that any loud noises that disturb the public are prohibited no matter what time it is. Police said it was difficult to hear what he was saying due to the loudness of his radio but when they advised him he would be cited he allegedly told them he "did not care because 'he beat the last citation'." Montyel Barnes, 44,733 Oakmont Ave., Steubenville, was cited for the loud radio, police said, and when the volume was jacked up again as the officer entered his cruiser he returned and confiscated the device. Police said claim Barnes told them he was going to get another speaker and turn the volume up, and they told him if he did they would confiscate it, too.
