WEIRTON — Weirton Council is working to update its animal cruelty laws, unanimously approving the first reading of a new ordinance Monday.

Ward 2 Councilman Ralph Cunningham sponsored the ordinance to amend Article 505.11(A)1, focused on cruelty to animals, in the city’s code.

Cunningham explained following the council meeting his hope is to stop animals from being left out in the extreme heat and cold, and other weather conditions.

“It’s got to stop,” Cunningham said.

Under the proposal, violations would include situations in which animals are left outdoors:

For more than 10 hours during a 24-hour period;

For more than 15 minutes between the hours of 10 p.m. and 6 p.m.;

Within 500 feet of a school for more than 15 minutes;

When the outside temperature is less than 32 degrees or more than 90 degrees Fahrenheit for more than 15 minutes;

During severe weather conditions or during severe weather advisories issued by local, state, or national weather services;

If a dog does not have access to potable water and an area of shade that permits the dog to escape the direct rays of the sun;

There is excessive waste or excrement in the area where the dog is tethered;

There are open sores or wounds on the dog’s body;

When the collar used to tether the dog is a pinch-type, prong-type, choke-type, or is not properly fitted to the dog;

If an animal control or police officer, in their discretion and with consideration of a dog’s breed, size or health, believes the conditions are too severe for a dog to safely remain outdoors.

Cunningham says he wants to see animals – whether it’s a dog, a cat, or another breed – properly taken care of and not neglected.

“If you can’t afford them, give them to someone who can take care of them,” he said.

Those found guilty of the city’s animal cruelty regulations – which is considered a misdemeanor – shall be fined up to $500, with the possibility of up to 30 days in jail.

The ordinance must be approved by a second reading before it can go into effect.
