Man sentenced in home invasion case
By MARK LAW, staff writerSTEUBENVILLE - Gary L. Roseberry Jr., 23, of 1432 Park View Circle was sentenced Wednesday to two years in prison by Jefferson County Common Pleas Judge Joseph Bruzzese Jr. for his part in an April 9 Mingo Junction home invasion.
Roseberry pleaded guilty to an amended indictment charging burglary. He initially was indicted on a charge of aggravated burglary.
Roseberry, Jeremy R. Degarmo, 22, of Apartment 13, 128 Grandview Ave., and Justin M. Calabrese, 21, of 1281 Sinclair Ave. were arrested at Degarmo's residence, less than a block from where the home invasion took place.
Mingo Junction Police reported two of the suspects broke into the home and held a gun to a male resident inside. The third suspect was let into the house through a back door, police reported.
A shotgun was pointed at a female inside the home.
Officers said cash was taken from the home.
The man inside the home was struck with a gun to the back of the head, and one of the suspects fired a shot inside the home.
Degarmo was indicted on two counts of felonious assault and single counts of aggravated burglary, with a firearm specification, and aggravated robbery. Calabrese was charged with single counts of aggravated burglary, with a firearm specification, and aggravated robbery.
Defense attorney Steven Stickles told Bruzzese at sentencing that Roseberry has a criminal record but all the prior offenses were drug related. Stickles said Roseberry does not have any violent offenses.
Stickles also said it was Roseberry who possibly prevented one if not two murders.
Testimony from the preliminary hearing stated the female victim said Roseberry kept saying not to shoot when a gun was pointed at the back of the male victim's head.
Roseberry gave county Assistant Prosecutor George Sarap a sworn statement as to what happened inside the Mingo Junction home.
Calabrese is scheduled for trial on Aug. 12, and Degarmo is set to go on trial on Aug. 19.
